These Terms of Service (the “Terms”) govern your access to and use of Scenarium (the “Service”). By accessing or using the Service, you agree to these Terms.
At a glance
The Service is provided by ObsidianCorps. Contact: info@obsidiancorps.com.
If you are using the Service on behalf of an Organization, you represent that you have authority to bind that Organization. The Organization is responsible for all activity under its accounts.
You agree not to:
If we publish additional guidelines or usage limits, they become part of these Terms. We may ask you to correct or remove content that violates these standards.
You will use reasonable measures to prevent unauthorized access to the Service (for example, use strong passwords and protect credentials) and promptly notify us of suspected account compromise.
We may suspend or restrict access if we reasonably believe there is a security risk, abusive activity, a violation of these Terms, or if required by law. We will use reasonable efforts to restore access once the issue is resolved.
The Service enables Organizations to create exercises, publish injects, collect responses, and generate reports/exports. Your Organization is responsible for the legality of its exercise content, notices to participants, and obtaining any required permissions.
The Service relies on role assignments (such as participant, editor, director, or administrator). Your Organization controls user access and is responsible for keeping role assignments accurate.
You (or your Organization) retain ownership of content uploaded to the Service (exercise data, injects, media, questions, responses, and exports). You grant us a limited license to host, process, and display that content solely to provide the Service.
You agree not to upload content that violates applicable laws, third-party rights, or your Organization’s policies.
If you provide feedback or suggestions, you grant ObsidianCorps a non-exclusive, worldwide, royalty-free license to use that feedback to improve the Service, without obligation to you.
We will treat Customer Content as confidential and will not access or use it except to provide the Service, support, security, compliance, or as otherwise instructed by the Organization.
You will ensure only authorized users access the Service and promptly remove access for users who should no longer participate.
Our processing of personal data is described in the Privacy Policy.
The Service may link to or integrate with third-party services. Third-party services are governed by their own terms and privacy policies, and ObsidianCorps is not responsible for third-party services.
We aim to provide reliable service, but the Service may be unavailable at times for maintenance or due to factors outside our control. We may update the Service and these Terms from time to time.
We will make reasonable efforts to provide notice of material changes, for example by email or in-product notifications.
Support channels and response times depend on your Organization’s plan or contract. Critical issues are prioritized based on impact.
If your Organization subscribes to a paid plan, fees, billing terms, and renewal details will be provided separately (for example in an order form, invoice, or contract).
Fees are exclusive of applicable taxes, which your Organization is responsible for unless stated otherwise in a signed agreement.
The Service, including its software, design, and trademarks, is owned by ObsidianCorps and protected by applicable laws. Except as expressly granted, no rights are transferred to you.
To the extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the extent permitted by law, ObsidianCorps will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to the Service.
If liability cannot be excluded, our total liability will not exceed the fees paid by your Organization for the Service in the twelve months before the event giving rise to the claim.
You agree to indemnify and hold harmless ObsidianCorps from claims arising out of your misuse of the Service, your Customer Content, or your violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms, security risks, or legal compliance.
Upon termination, your access ends and data handling will follow contractual and legal requirements. Exports may be available prior to termination if requested by your Organization.
The Service may provide export features (for example PDF/JSON). Export availability may depend on plan. Deletion requests may be subject to legal, security, or contractual retention requirements.
If your Organization needs a DPA or subprocessors list, contact info@obsidiancorps.com.
Governing law and venue depend on the agreement with your Organization and/or your place of business. If you need a jurisdiction-specific clause, contact info@obsidiancorps.com.
